Texas psychiatrist pays $3M to settle unnecessary brain stimulation charges

A 61-year-old Texas physician and companies he owned and operated are paying $3 million to resolve claims they improperly billed Medicare, the Justice Department said March 3.

Ashok Jain, MD, and Psychiatric Solutions, Longview Psychiatric Center and Longview Psychiatric Center LP submitted false claims to Medicare, the Justice Department alleged. The allegations included intentionally pressuring patients to accept unnecessary medical treatments and billing for those treatments, falsifying treatment records and billing Medicare for unnecessary services and services they did not provide.

Dr. Jain and the clinics allegedly submittec claims to Medicare for transcranial magnetic stimulation procedures that were not performed, routinely administered TMS treatments without a valid medical purpose and improperly billed Medicare for reimbursement of those treatments, the department said. They also billed Medicare for physician assessments when the physician did not see the patient or supervise the TMS treatment. 

The July 15, 2021 whistleblower complaint indicated the fraudulent conduct continued until the business was sold in April 2022.
