Georgia issues $25M in fines to 11 insurers over mental health parity violations

Georgia has issued nearly $25 million in fines to 11 health insurers for violating state mental health parity laws.

The penalties follow market conduct examinations that began after a 2023 data call report revealed potential violations of requirements that insurers provide mental health and substance use disorder coverage comparable to physical health benefits. The examinations, which were announced in August 2025, reviewed 22 insurers’ compliance with Georgia’s Mental Health Parity Act and the federal Mental Health Parity and Addiction Equity Act.

“I said it before and I’ll say it again: insurance companies will not take advantage of consumers under my watch,” Georgia Insurance and Safety Fire Commissioner John King said Jan. 12. “These companies are not above the law, and I am taking definitive action to hold them accountable for denying Georgians the care they need.”

The state’s first mental health parity data call report was issued Aug. 15, 2023, prompting regulators to launch audits of insurers’ business practices. The examinations reviewed data, processes and strategies for benefit applications and non-quantitative treatment limitations.

The insurers are required to develop corrective action plans with state regulators to achieve compliance with the law. Companies that fail to follow their corrective action plans may face additional enforcement measures, according to the commissioner’s office.

Oscar Health received the largest penalty at $10.2 million, followed by Anthem Blue Cross Blue Shield Georgia at $4.6 million and Kaiser Foundation Health Plan at $2.6 million.
