The California Legislature passed Senate Bill 903, which would prohibit AI algorithms from providing or advertising therapy or psychotherapy in California, according to an Aug. 31 news release from Sen. Steve Padilla’s office.
Here are three things to know:
1. The bill would prohibit individuals or companies, including those using AI, from offering or advertising therapy or psychotherapy in California if the services are provided by a companion chatbot.
2. Licensed professionals could use AI only for limited administrative or supplementary support. AI could not independently interact with clients, make therapeutic decisions, detect emotions or generate treatment plans without professional review. The measure would require clear disclosure and affirmative consent before AI is used to record or transcribe therapy sessions. It would also require confidentiality of therapy records.
3. Senate Bill 903 passed the Senate unanimously and the Assembly by a vote of 71 to 4. The bill now heads to Gov. Gavin Newsom’s desk for his signature. The California Psychological Association, California Association of Marriage and Family Therapists, California Behavioral Health Association and National Union of Healthcare Workers co-sponsored the measure.
